1. Acceptance of Terms
By accessing, registering on, or using iDEX Exchange (the "Platform", "we", "us", or "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). If you do not agree with any part of these Terms, you must not use the Platform.
These Terms apply to all visitors, registered users, and any other person who accesses or uses the Platform. Your continued use of the Platform following any update constitutes acceptance of the revised Terms.
2. Eligibility
To use the Platform, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher).
- You have the full legal capacity to enter into a binding contract.
- You are not a resident of, or located in, any jurisdiction where crypto trading is prohibited by law (including but not limited to sanctioned territories).
- You are not listed on any sanctions list maintained by the UN, EU, US OFAC, UK, or any comparable authority.
- You will use the Platform in compliance with all applicable laws and regulations in your jurisdiction.
It is your sole responsibility to determine whether your use of the Platform is legal in your jurisdiction.
3. Your Account
3.1 Registration
To access trading services, you must register by providing an email address and a password. We do not require identity documents (no KYC), phone numbers, or other personal identifiers. You are solely responsible for the accuracy of the information you provide.
3.2 Security
You are responsible for keeping your password confidential and for all activity that occurs under your account. We are not responsible for any loss arising from unauthorized access caused by your failure to safeguard your credentials. Notify us immediately if you suspect unauthorized access.
3.3 One Account Per Person
You may not create multiple accounts to circumvent limits, bans, or investigations. We may merge, freeze, or terminate duplicate accounts.
4. Services
iDEX Exchange provides a non-custodial-style centralized crypto spot exchange. Depending on availability, the Platform allows you to:
- Deposit supported crypto assets to a unique address;
- Place market and limit orders on supported trading pairs;
- View real-time order books, charts, and trade history;
- Withdraw supported crypto assets to external wallets.
We reserve the right to add, modify, suspend, or remove any feature or supported asset at any time, without prior notice.
5. Fees
Our current fee structure is:
- Spot trading fee: 0.10% per executed order (taker and maker).
- Deposits: free — the underlying blockchain network fee is not charged by us.
- Withdrawals: subject to network fees as displayed in the withdrawal form at the time of submission.
Fees are subject to change. Any change will be reflected on the Platform and will apply to future transactions only.
6. Deposits & Withdrawals
6.1 Deposits
You must send the exact asset to the exact address and network displayed. Assets sent to the wrong address or network are permanently lost. Deposits are credited after the required number of confirmations indicated on the deposit page.
6.2 Withdrawals
Withdrawals are processed manually and require your balance to be sufficient. Once broadcast to the blockchain, a withdrawal is irreversible. Verify your destination address carefully — we cannot recall funds sent to a wrong address.
6.3 Minimums
Minimum deposit and withdrawal amounts are set per network. Additionally, we may apply a per-user minimum withdrawal value in USD, at our sole discretion.
7. Prohibited Use
You agree not to use the Platform for:
- Money laundering, terrorist financing, or any activity that violates AML/CFT laws;
- Market manipulation, wash trading, spoofing, or layering;
- Fraud, phishing, or impersonation of any person or entity;
- Transmitting malware, exploiting bugs, or attempting to breach security;
- Using automated bots without prior written consent, except via our public APIs;
- Any activity that violates applicable local, national, or international law.
We may freeze funds, close accounts, and report suspicious activity to competent authorities, at our sole discretion, without prior notice.
8. Risk Disclosure
By using the Platform, you acknowledge and accept the following risks:
- Market risk: Crypto asset prices are extremely volatile and may fall to zero.
- Liquidity risk: Some pairs may have limited liquidity and cannot always be bought or sold at the expected price.
- Technology risk: Blockchains, smart contracts, and our systems may fail, be hacked, or experience outages.
- Regulatory risk: Laws may change and affect your ability to use or withdraw funds.
- No insurance: Balances held on the Platform are not insured by any government program (FDIC, SIPC, or similar).
- Irreversibility: Blockchain transactions cannot be reversed.
You accept full responsibility for any losses that may arise from these risks.
9. Intellectual Property
All content on the Platform — including code, design, logos, text, graphics, and the "iDEX Exchange" name — is owned by us or licensed to us. You may not copy, modify, distribute, or reverse-engineer any part of it without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, iDEX Exchange, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Platform.
Our total aggregate liability for any claim arising out of or relating to these Terms shall not exceed the greater of (i) the total fees paid by you to the Platform in the three (3) months preceding the claim, or (ii) USD 100.
11. Suspension & Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if:
- You breach these Terms;
- We are required to do so by law or by a competent authority;
- Your account is involved in suspicious, fraudulent, or illegal activity;
- We discontinue the Platform or a specific service.
You may close your account at any time via Settings. Prior to termination, you remain responsible for withdrawing any remaining balances.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which iDEX Exchange is established, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively through binding arbitration in that jurisdiction, except where prohibited by local consumer-protection law.
